These Terms and Conditions of Sale apply to all orders placed on the website operated by FATALE by Emma.
By placing an order on this website, the customer confirms that they have read, understood and accepted these Terms and Conditions of Sale.

FATALE by Emma may be referred to as “we”, “us” or “our” in these Terms and Conditions of Sale.
2. Products
FATALE by Emma offers fashion accessories, including Signature Pins and Interchangeable Jewels.
Each product is described as accurately as possible on its product page. The customer is invited to read the product description carefully before placing an order, including information relating to materials, dimensions, colors, usage and care instructions.
Product images are provided for illustrative purposes. Slight variations may occur due to screen display, photography, lighting, artisanal production or natural material variations.
3. Prices
Prices are displayed in euros (€), inclusive of applicable taxes unless otherwise stated.
Shipping costs are not included in the product price unless expressly indicated. They are calculated and displayed at checkout before the customer confirms the order.
FATALE by Emma reserves the right to modify its prices at any time. Products are invoiced based on the prices displayed at the time the order is confirmed.
4. Orders
To place an order, the customer selects the desired product(s), adds them to the cart, checks the order summary and provides the required information for payment and delivery.
Before confirming the order, the customer has the opportunity to review and correct any errors.
The order is only final once payment has been successfully completed and the customer has received an order confirmation email.
FATALE by Emma reserves the right to refuse or cancel an order in the event of abnormal demand, suspected fraud, payment issue, incorrect customer information, stock error or legitimate reason.
5. Payment
Payment is due immediately at the time of order.
Accepted payment methods are those displayed at checkout, such as credit/debit card, Shop Pay, PayPal or any other payment method made available on the website.
Payments are processed through secure third-party payment providers. FATALE by Emma does not store full payment card details.
The order will only be processed after payment has been validated.
6. Availability
Products are offered subject to availability.
If a product becomes unavailable after the order has been placed, FATALE by Emma will inform the customer as soon as possible by email. The customer may then choose between a refund, an exchange where possible, or another solution agreed with FATALE by Emma.
7. Shipping
Orders are prepared and shipped from France.
Shipping methods, estimated delivery times and shipping costs are displayed at checkout before payment.
Estimated delivery times are provided for information purposes and may vary depending on the destination, carrier, customs processing, peak periods or circumstances outside our control.
Once the order has been shipped, the customer will receive a confirmation email with tracking information when available.
8. Delivery
The customer is responsible for providing accurate and complete delivery information.
FATALE by Emma cannot be held responsible for delivery delays, failed delivery or loss caused by incorrect or incomplete information provided by the customer.
If a parcel is returned to FATALE by Emma due to incorrect delivery information, refusal of delivery or failure to collect the parcel, additional shipping fees may apply for reshipment.

9. Right of withdrawal
In accordance with applicable consumer law, customers located in the European Union generally have the right to withdraw from their online purchase within 14 days from the day after receiving the order, without having to provide a reason.
For orders containing multiple products delivered separately, the withdrawal period begins on the day after the customer receives the last product.
To exercise the right of withdrawal, the customer must notify FATALE by Emma before the end of the 14-day period by sending a clear statement by email to:

The customer may use the withdrawal form included at the end of these Terms and Conditions of Sale, but it is not mandatory.
10. Return conditions
After notifying FATALE by Emma of their decision to withdraw, the customer must return the product(s) within 14 days.
Products must be returned in their original condition, complete, clean, undamaged and, where possible, in their original packaging, with any accessories, cards or protective elements included.
The customer is responsible for handling the product with care. The customer may be held liable for any decrease in value resulting from handling other than what is necessary to establish the nature, characteristics and proper functioning of the product.
Return shipping costs are the responsibility of the customer, unless the product received is defective, damaged or incorrect.

The customer is advised to use a tracked shipping method. FATALE by Emma is not responsible for returns lost or damaged in transit.
11. Refunds
In the event of a valid withdrawal, FATALE by Emma will refund the customer using the same payment method used for the original order, unless otherwise agreed.
The refund will include the price of the returned product(s) and standard delivery costs where applicable. Additional costs resulting from the customer choosing a more expensive delivery method than the standard delivery option will not be refunded.
FATALE by Emma may withhold the refund until the returned product(s) have been received or until the customer has provided proof of shipment.
Refunds will be processed within 14 days from the date on which FATALE by Emma is informed of the customer’s decision to withdraw, subject to the conditions above.
12. Exceptions to the right of withdrawal
The right of withdrawal may not apply to certain products, including products that are made to the customer’s specifications or clearly personalized.
If a product is not eligible for withdrawal, this will be clearly stated on the relevant product page before purchase.
This does not affect the customer’s legal rights in the event of a defective or non-compliant product.
13. Damaged, defective or incorrect products
The customer should inspect the order upon receipt.
If the product is damaged, defective or incorrect, the customer must contact FATALE by Emma as soon as possible at:

The customer should include:
- order number;
- description of the issue;
- photos of the product, packaging and shipping label where relevant.
If the issue is confirmed, FATALE by Emma will offer an appropriate solution, such as repair, replacement, refund or another solution in accordance with applicable law.
14. Legal guarantees
All products sold by FATALE by Emma benefit from the legal guarantees provided by applicable consumer law, including the legal guarantee of conformity and the guarantee against hidden defects.
Under the legal guarantee of conformity, the customer may request that a defective or non-compliant product be brought into conformity, repaired or replaced, under the conditions provided by law.
These legal guarantees apply independently of any commercial gesture or additional warranty that may be offered by FATALE by Emma.
15. Product care and use
The customer must use the products in accordance with their intended purpose and any care instructions provided.
FATALE by Emma cannot be held responsible for damage caused by misuse, abnormal use, impact, improper storage, exposure to water, heat, chemicals, perfume, cosmetics or any other external factor not related to a defect in the product.

17. Liability
FATALE by Emma shall not be held liable for any failure or delay in performing its obligations caused by an event beyond its reasonable control, including but not limited to carrier disruption, customs delay, technical failure, natural disaster, strike, pandemic, administrative restriction or force majeure event.
FATALE by Emma’s liability is limited to direct and foreseeable damages resulting from the order, in accordance with applicable law.
18. Intellectual property
All content available on the website, including texts, photographs, images, illustrations, logos, graphics, product names, designs and brand elements, is protected by intellectual property rights.
Any reproduction, distribution, modification or use of this content without prior written authorization from FATALE by Emma is prohibited.
19. Personal data
FATALE by Emma processes personal data in order to manage orders, deliveries, customer service, legal obligations and, where applicable, marketing communications.

20. Consumer mediation
In the event of a dispute, the customer is invited to contact FATALE by Emma first in order to seek an amicable solution.
If no amicable solution is found, the customer may have access to a consumer mediation service in accordance with applicable consumer law.
The customer must first attempt to resolve the dispute directly with FATALE by Emma before contacting the mediator.
21. Applicable law
These Terms and Conditions of Sale are governed by French law.
In the event of a dispute, the customer may bring the matter before the competent courts in accordance with applicable legal rules.
22. Changes to these Terms and Conditions of Sale
FATALE by Emma reserves the right to update or modify these Terms and Conditions of Sale at any time.
The applicable Terms and Conditions of Sale are those in force at the time the order is placed.
